Reference: US FDA Letter of Guaranty
This declaration applies to all packaging and packaging materials designed, specified, or intended to
contain or contact food or food ingredients, and are based on the most current information available at the
date of this document. These statements are based on similar declarations and guaranties from our direct
material suppliers and our own knowledge of our GFSI certified processes.
Food Contact Declaration of Compliance
We confirm that the packaging described above meets the following regulatory requirements for food
contact materials:
• US FDA 21 CFR 176.170 Components of paper and paperboard in contact with aqueous and fatty
foods.
• US FDA 21 CFR 176.180 Components of paper and paperboard in contact with dry food. US FDA
21 CFR 177 Indirect Food Additives: Polymers [subpart as applicable to the films employed]
• US FDA 21 CFR 175.105 Adhesives.
• 21 CFR 177.2800 Textile and Textile Fibers, 21 CFR 177.1630 Polyethylene phthalate polymers,
and 21 CFR 178.3570 Lubricants with incidental food contact.
• EU Framework Regulation EU 1935/2004 (Materials are articles intended to come in contact with
foodstuff).
• European Union Regulation (EU) No 10/2011 of 14 January 2011 on plastic materials and articles
intended to come into contact with food (as currently amended).
• Health Canada Division 23 of the Food and Drugs Act and Regulations, Section B.23.001.
These packaging materials were manufactured in compliance with the following good manufacturing
practices:
• US FDA 21 CFR 117 Current Good Manufacturing Practice, Hazard Analysis, and Risk-Based
Preventive Controls for Human Food.
• [EU] Commission Regulation (EC) No 2023/2006 of 22 December 2006 on good manufacturing
practice for materials and articles intended to come into contact with food.
This FDA compliance declaration covers packaging materials for the food types as defined by 21 CFR
176.170 Components of paper and paperboard in contact with aqueous and fatty foods, Table 1, and food
packaging under conditions of use as defined by 21 CFR 176.170 Components of paper and paperboard in
contact with aqueous and fatty foods Table 2, B. through H. and referred to in 21 CFR 177.1520
Polyolefins. These packaging materials are therefore suitable for food products that are technically
compatible and under conditions of use that do not exceed the specific packaging’s physical utility (note:
this may limit effective conditions of use to 21 CFR 176.170 D. through G.).
U.S. Food, Drug and Cosmetic Act Continuing Guaranty
BagTape Closures hereby guarantees that no article described above is adulterated or misbranded within
the meaning of the Federal Food, Drug, and Cosmetic Act, or is an article which may not, under the

provisions of section 404, 505, or 512 of the act, be introduced into interstate commerce. This is a
continuing guaranty subject to revocation of written notice, and revokes and supersedes all prior
guarantees, and is deemed to be part of each of our orders, acknowledgements and invoices covering your
business and is subject to the limitation expressed in the guaranty of those contained in our standard terms
and conditions of sale.
