Airgas USA, LLC (“Airgas”) is currently supplying your company with liquid carbon dioxide (LCO2 – the “Product”). Your company has requested that Airgas provide it with information regarding the process by which the Product is produced at the facility and whether such Product contains food allergens and other sensitive ingredients. The process by which the Product is manufactured by Airgas is as follows: Carbon dioxide is a recovered by-product from the thermal cracking of hydrocarbons. The raw CO2 feed gas is purified in several stages compressed and cooled to produce LCO2. None of the following ingredients are intentionally added to, or part of, the recovery, purification and liquefaction process: Any major food allergens within the meaning of the Food Allergen Labeling and Consumer Protection Act of 2004 (Title II of Public Law 108-282): milk, egg, fish, Crustacean shellfish, tree nuts, wheat, peanuts, and soybeans. Molluscan shellfish and derived products Sesame seeds and derived products Mustard and derived products Gluten Lactose Celery and derived products Lupin and derived products Buckwheat and derived products Sulfites, including sulfur dioxide. If present, they are considered to be present in an insignificant amount of less than 10 ppm as stated in 21CFR.101.100 (a)(4). MSG (Monosodium Glutamate) FD&C Yellow No. 5 The Product is not processed in a facility that also processes any of the above listed ingredients. The Product is not stored with any of the above listed ingredients. Airgas is providing this letter to your company with the understanding that it is your company’s or customer’s responsibility, to assure that the intended use of the Product complies with the Federal Food Drug and Cosmetic Act (FD&C Act), the Food Allergen Labeling and Consumer Protection Act (FALCPA) and other applicable laws including but not limited to the Meat and Poultry Product Inspection Acts. Airgas makes no warranty of any kind herein, express or implied, including without limitation, warranties of merchantability and fitness for a particular purpose. Airgas also expressly disclaims liability and responsibility for loss or damage resulting from the use of this information.
