Ethyl Alcohol 190 proof (E190DP)

Title 21 CFR 101.91 defines the term "gluten free," in part, as a food that does not contain more than 20ppm gluten. The FDA finalized rule "Gluten-Free Labeling of Fermented or Hydrolyzed Foods" on August 12, 2020 and it became effective September 14, 2020. Per this rule, FDA will now allow a "gluten-free" claim on food that is distilled (such as alcohol) based on "verifying the absence of protein in the distilled component using scientifically valid analytical methods that can reliably detect the presence or absence of protein or protein fragments in food." Our supplier, MGP Ingredients, Inc. distilled alcohol has been analyzed via a R5 competitive ELISA method and results were below the limit of quantitation of 10ppm hydrolysate (wheat/rye/barley) gluten. Regarding alcohol labeling under the authority of the Department of Treasury, Alcohol and Tobacco Tax and Trade Bureau (TTB), at the date of this document, 09/24/2020, the TTB has not revised its interim policy on gluten content statements for labeling distilled spirits per FDA's new "Gluten-Free labeling of Fermented or Hydrolyzed Foods" rule.
