The food contact surfaces of any of our multiwall bags do not contain components derived from food types as listed in the Food Allergen Labeling and Consumer Protection Act of 2004 (FALCPA) and in Annex IIIa of European Union Directive 2000/13/EC as amended by Directives 2006/142/EC and 2003/89/EC). These food types include: Cereals containing gluten, wheat, crustaceans, eggs, fish, peanuts, soybeans, milk, tree nuts, celery, mustard, sesame seeds, sulfur dioxide and sulfites, lupines, and mollusks. In addition sunflower seeds, oil or by-products are neither specified in raw materials nor are knowingly incorporated in any Hood Packaging products as there is no specific technical or commercial reason for their use. Some of our manufacturing facilities utilize flexographic exterior ply printing inks that are formulated with soy protein. These inks are applied to the exterior printed surfaces only, and multiwall plies provide an effective barrier between the applied inks on the outer ply and the packaging’s inside food contact surface assuring non-migration to the product packaged within. It is our interpretation of FALCPA that it is not applicable to exterior ply printing inks. The FDA has been asked to clarify the status of packaging under FALCPA, with the agency being urged to grant a blanket exemption from FALCPA labeling requirements for all packaging materials. However guidance from the FDA on this matter has so far not been forthcoming.
