According to the European Regulation (EC) No 1333/2008 on food additives and the ‘NATCOL Code of Practice for the Classification, Manufacturing, Use and Labelling of Coloring Foods (EU)’ EXBERRY® products are considered as food ingredients with coloring properties, so called “Coloring Foods” and are not considered as food additives (colors), which need to be approved as such and labelled with an E-number.

According to the notification of the Ministry of Public Health (No. 281) B.E. 2547 Re: food additives, fruit and/or vegetable concentrates, like EXBERRY® products, which are used for the purpose of imparting color to food, are classified as food additives in Thailand.
This classification however should be distinguished from food additives in Thailand which require authorisation with an allocated INS number and maximum permitted levels for the usage in specific types of food. EXBERRY® fruit and/or vegetables concentrates are classified as “color extracts from parts of plants” for which specific requirements have been published by the Thai FDA as laid down in the Thai “Quality requirement or standard for color extracts from plants or animals”.
